1. GENERAL PROVISIONS
1.1. These Terms and Conditions (the “Rules”) establish the general conditions for purchasing goods on the website pinnpatch.eu (the “Store”).
1.2. The Store is managed and operated by MB Kiriro, Company Code: 307548550, Registered Address: Vilnius, Gerosios Vilties g. 5A-104, LT-03147, Lithuania (the “Seller”).
1.3. A “Buyer” is any person (competent adult or legal entity) purchasing goods from the Store. By placing an order, the Buyer confirms they meet these eligibility requirements.
1.4. By completing an order, the Buyer unconditionally confirms they have read and agreed to these Rules. The Seller is not liable for risks arising if the Buyer fails to read the Rules.
1.5. The Rules: These Rules define the mutual rights, obligations, and responsibilities of the Buyer and the Seller regarding the purchase of goods in the Store.
1.6. Right to Amend: The Seller reserves the right to change, correct, or supplement these Rules at any time in accordance with legal requirements. The Rules in effect at the moment of order placement shall apply. It is recommended that the Buyer reviews the Rules during every purchase.
1.7. Agreement: The Buyer cannot place an order if they have not read or do not agree to these Rules. The Seller assumes no responsibility or risk if the Buyer has not familiarized themselves with the Rules, provided the opportunity was given.
1.8. Seller Responsibility: The Seller is responsible for the sale of ordered goods, proper delivery, quality of goods, fulfillment of return conditions, and other rights and duties established by law.
1.9. Account Restrictions: The Seller has the right to limit the Buyer’s use of the Store or cancel their registration without notice if the Buyer violates these Rules or attempts to harm the stability or security of the Store’s operations.
2. REGISTRATION AND PERSONAL DATA
2.1. The Buyer can order goods in the electronic store by:
2.1.1. registering in the store by entering the requested data;
2.1.2. without registering in this electronic store.
2.2. When ordering, the Buyer must indicate the personal data necessary for proper fulfillment: name, surname, delivery address, phone number, and email address.
2.3. By confirming these rules, the Buyer agrees that the provided personal data will be processed for the purposes of purchasing, delivery, and accounting. Marketing offers will be provided only with separate consent.
2.4. The Buyer has the right to change, supplement, or cancel their registration data at any time.
2.5. The Buyer creates individual login data and undertakes to keep them secret. The Buyer is responsible for the complexity of their password and all actions (orders, comments, etc.) performed under their individual login.
2.6. If a third party uses the Store’s services using the Buyer’s login data, the Seller considers this person to be the Buyer.
2.7. The Buyer may provide their email address for newsletters and offers. This consent can be revoked at any time by clicking the link in the newsletter or informing the Seller directly.
3. PRICES, PAYMENT ORDER, AND TERMS
3.1. Prices in the Store and in the formed order are indicated in Euros with VAT. Goods are sold at the prices valid at the time of placing the order.
3.2.1. Payment using electronic banking – this is an advance payment using the electronic banking system used by the Buyer.
3.2.2. Payment by bank transfer – this is an advance payment where the Buyer transfers money to the Seller’s indicated settlement account within 2 days of placing the order.
3.3. The Buyer undertakes to pay for the goods immediately. Only after receiving payment does the formation of the parcel and the calculation of the delivery term begin.
4. ORDERING AND DELIVERY OF GOODS
4.1. The Buyer can shop in the electronic store 24 hours a day, 7 days a week.
4.2. Už prekių pristatymo per kurjerį ar į siuntų taškus paslaugas taikomi prekių užsakymo pateikimo metu galiojantys įkainiai, nurodyti Elektroninėje parduotuvėje. Prekių pristatymo kaina taikoma visam užsakytam prekių krepšeliui ir atskiroms prekėms nedalijama.
4.2. Rates valid at the time of placing the order apply for courier or parcel point delivery services.
4.3. If the order is paid on a working day before 12:00, goods are sent within 2 working days. If paid after 12:00 or on a non-working day, they are sent within 3 working days.
4.4. If delivery is impossible not due to the Seller’s fault (e.g., incorrect address) or the Buyer does not pick up the goods, the Seller may terminate the contract and refund the money minus delivery costs.
4.5. The Seller delivers goods according to the terms indicated in the descriptions. These terms are preliminary and do not apply if the required goods are not in the warehouse.
4.6. The Seller is released from liability for violation of delivery terms if the goods are not presented due to the Buyer’s fault or circumstances beyond the Seller’s control.
4.7. The Buyer must immediately inform the Seller if the shipment is presented in crushed or otherwise damaged packaging, or if the shipment contains unordered goods or incorrect quantities.
4.8. When accepting goods, the Buyer must inspect the condition of the packaging, quantity, quality, and assortment. If defects are noticed, the Buyer must refuse the shipment and fill out a special parcel inspection report with the courier.
5. QUALITY GUARANTEE AND SHELF LIFE
5.1. Data for the goods sold are indicated in the product description accompanying each item.
5.2. The Seller is not responsible for the fact that goods in the store may not match the real size, shape, and color due to the characteristics of the monitor used by the Buyer.
5.3. Defects of sold goods are eliminated, and low-quality goods are replaced or returned in accordance with the Retail Trade Rules approved by the Government of the Republic of Lithuania and the Civil Code.
6. WITHDRAWAL, EXCHANGE, AND RETURNS
6.1. The Buyer has the right to withdraw from the contract by notifying pinnpatch.eu in writing no later than within 14 calendar days from the delivery date via info@pinnpatch.eu.
6.2. After providing written notice, the Buyer must return the item within 5 calendar days.
6.3. Based on Art. 6.228-10 of the Civil Code, the Buyer does not have the right to return quality goods that they have used, damaged, unpacked, or personalized to the Buyer’s personal needs.
6.4. Goods are considered to be of low quality if the expiration date has passed, they contain prohibited substances, or they are mechanically damaged before transfer to the Buyer.
6.5. Returned quality goods must be undamaged, unpacked, and have not lost their commercial appearance. The item must be returned in the original packaging.
6.6. Return items to the address: Vilnius, Gerosios Vilties 5a-104, LT-03147. The shipping service is paid for by the customer.
6.7. Money is returned to the Buyer’s account no later than within 14 days from the return of the goods.
7. FINAL PROVISIONS
7.1. These Rules are drawn up in accordance with the legal acts of the Republic of Lithuania.
7.2. The law of the Republic of Lithuania applies to the relationships arising on the basis of these Rules.
7.3. In the event of damage, the guilty party compensates the other party for direct losses in accordance with the laws of the Republic of Lithuania.
7.4. All disagreements are resolved through negotiation. If failed, disputes are resolved in accordance with the laws of the Republic of Lithuania.
7.5. Consumers can resolve disputes electronically via the State Consumer Rights Protection Authority (www.vvtat.lt) or the EGS platform (http://ec.europa.eu/).
